These Terms & Conditions ("Terms"), together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy, govern your access to and use of our Services and purchases made through our store.

Nothing in these Terms is intended to exclude or restrict any right, remedy or liability that cannot lawfully be excluded or restricted under the laws of the Republic of Trinidad and Tobago.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.

You may not use our Services for any unlawful or fraudulent purpose.


2. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and compatibility information displayed on our website are accurate.

Product packaging, labelling, colours and appearance may occasionally change as a result of manufacturer or supplier updates. Product images may therefore be illustrative where packaging or other non-material characteristics have changed.

Manufacturers may revise, replace or supersede part numbers, specifications, packaging and product designs from time to time.

Where a particular brand, specification, part number, country of manufacture or product characteristic is important to your purchase, please contact us before ordering if you require confirmation.


3. GENUINE, OEM AND AFTERMARKET PRODUCTS

Products offered by DRL Performance Auto Limited may include Genuine/OE, OEM, OEM-equivalent and aftermarket products.

Where a particular brand, manufacturer or product type is specified in a product listing, the product supplied will correspond materially with that description.

Manufacturer packaging, labelling, product appearance and part numbers may change from time to time. Manufacturers may also supersede an existing part number with a replacement or updated part number without materially changing its intended application.

References to vehicle manufacturers, vehicle models, trademarks or original part numbers may be used for identification and compatibility purposes and do not necessarily indicate that a product is manufactured or endorsed by the vehicle manufacturer unless specifically described as Genuine/OE.

If a particular brand, manufacturer, country of manufacture, part number or specification is important to your purchase and is not clearly stated in the product listing, please contact us before ordering.


4. VEHICLE FITMENT AND COMPATIBILITY

Automotive part compatibility can vary according to vehicle model, model year, engine, transmission, chassis number, VIN, production date, market specification and other vehicle-specific information.

Customers are responsible for providing complete and accurate vehicle information when requesting fitment assistance.

Where possible, we may assist customers in identifying suitable products based on the information provided. Our ability to verify compatibility depends on the accuracy and completeness of that information and on manufacturer, supplier, catalogue and other technical information reasonably available to us.

If you are uncertain about compatibility, please contact us before ordering or installing the product.

DRL Performance Auto Limited is not responsible for incompatibility resulting from incorrect, incomplete or misleading vehicle information supplied by the customer.


5. INSTALLATION AND USE OF AUTOMOTIVE PRODUCTS

Automotive parts, fluids and accessories must be correctly installed and used in accordance with applicable manufacturer instructions, specifications and recommended procedures.

Where professional knowledge, specialised equipment or technical procedures are required, installation should be carried out by a suitably qualified person.

Customers and installers are responsible for inspecting products before installation and confirming, where reasonably possible, that the product, application and specifications are correct.

To the fullest extent permitted by applicable law, DRL Performance Auto Limited is not responsible for loss, damage, failure or expense resulting from:

  • Improper or incorrect installation;

  • Installation using incorrect procedures or equipment;

  • Use of an incorrect product or application resulting from inaccurate or incomplete information supplied to us;

  • Misuse, abuse, neglect or inadequate maintenance;

  • Unauthorised modification of a product;

  • Failure to follow manufacturer instructions or specifications;

  • Contamination of parts, fluids or friction materials;

  • Continued operation after a fault, warning light, warning indication or other abnormal condition becomes apparent; or

  • Use outside the manufacturer's intended operating conditions.

To the fullest extent permitted by applicable law, DRL Performance Auto Limited shall not be responsible for consequential expenses arising from circumstances described above, including mechanic or technician labour charges, diagnostic charges, towing or recovery costs, machine-shop charges, removal or reinstallation costs, storage charges, vehicle-rental or substitute-transportation expenses, loss of use, loss of income, loss of profits or other indirect or consequential financial loss.


6. SAFETY-CRITICAL COMPONENTS

Certain automotive products, including braking, steering, suspension and related components, are safety-critical.

Such products should be correctly selected, inspected and installed using appropriate procedures by a suitably qualified person where professional installation is appropriate.

After installation, any unusual noise, vibration, leakage, warning indication, abnormal operation, reduction in braking or steering performance, visible damage or other abnormal condition should be investigated promptly.

Where continued vehicle operation could reasonably create a safety risk or increase damage, use of the vehicle should be discontinued until the vehicle and relevant components have been appropriately inspected.

Failure to take reasonable action after a fault or abnormal condition becomes apparent may result in additional damage for which DRL Performance Auto Limited accepts no responsibility to the fullest extent permitted by applicable law.


7. PERFORMANCE AND MOTORSPORT PRODUCTS

Certain products offered by DRL Performance Auto Limited may be intended for performance, competition, motorsport or other specialised applications.

Customers are responsible for determining whether such products are suitable and lawful for their intended use.

Vehicle modification and motorsport may involve additional risks and may affect manufacturer warranties, insurance coverage, vehicle reliability, emissions compliance or roadworthiness.

Product performance varies according to vehicle configuration, installation, tuning, operating conditions and numerous other factors. Unless expressly stated otherwise, no guarantee is made regarding specific horsepower, performance, lap-time, braking or other results.

Nothing in this section excludes or restricts any liability that cannot lawfully be excluded or restricted.


8. THIRD-PARTY MANUFACTURED PRODUCTS AND PRODUCT CLAIMS

DRL Performance Auto Limited sells products manufactured by a range of independent third-party manufacturers and suppliers.

Unless expressly identified as a product manufactured by DRL Performance Auto Limited, DRL Performance Auto Limited is not the manufacturer of those products and does not control their manufacturing processes, materials, quality-control procedures or production facilities.

Manufacturer or distributor warranties may apply to certain products and are subject to their respective terms, conditions, exclusions and claim procedures.

Where a manufacturing defect, material defect or product failure is suspected, the customer should discontinue use where continued use may reasonably be unsafe or cause additional damage and contact us as soon as reasonably practicable.

The customer may be required to retain and provide the product, packaging, proof of purchase, photographs, installation information, vehicle information and other evidence reasonably required to assess or refer the claim.

Products involved in a claim should not be discarded, dismantled, modified, repaired or otherwise altered where doing so could prevent reasonable inspection, except where action is reasonably necessary for safety.

Where appropriate, a product may be submitted to the manufacturer, supplier, distributor or another relevant party for inspection and assessment.

DRL Performance Auto Limited does not independently guarantee that every latent or concealed manufacturing defect will be detectable before sale.

Nothing in this section constitutes an admission or assumption of liability by DRL Performance Auto Limited for a product failure, manufacturing defect, accident, injury, property damage or other resulting loss. Responsibility for any particular claim will depend upon the circumstances of that claim and applicable law.


9. ORDERS AND ORDER ACCEPTANCE

Placing an order through our website constitutes an offer to purchase.

Receipt of an automated order confirmation does not necessarily constitute final acceptance of an order.

We may decline or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • Payment cannot be authorised or verified;

  • The order appears fraudulent or suspicious;

  • A material pricing or product-information error has occurred;

  • Delivery information is incomplete or cannot reasonably be serviced;

  • Delivery cannot reasonably or safely be completed; or

  • We are unable lawfully to fulfil the order.

If payment has already been received for an order that we subsequently cannot fulfil, the applicable amount will be refunded.

Please review your order carefully before submitting it. Once an order has been processed, prepared for dispatch or transferred to a courier, cancellation may no longer be possible.

Returns and exchanges are governed by our Returns & Refunds Policy and applicable law.


10. PRICES AND PAYMENT

Unless otherwise indicated, prices displayed on our website are in Trinidad and Tobago Dollars (TTD).

Prices, promotions and product availability may change without notice.

The price applicable to an accepted order will normally be the price displayed when the order was placed, subject to correction of genuine and obvious pricing, product-information or technical errors.

If a material pricing or product-information error affects an order, we may contact the customer with the correct information and provide the option to proceed where appropriate. If an affected order is cancelled after payment has been received, the applicable amount will be refunded.

Delivery charges, where applicable, will be shown separately or communicated to the customer.

Customers must provide accurate billing and payment information and must be authorised to use the payment method provided.


11. SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy.

Delivery timeframes are estimates and are not guaranteed.

Delivery may be affected by severe weather, flooding, natural disasters, road conditions, unsafe delivery locations, public holidays, transportation disruptions, courier operational issues and other circumstances outside our reasonable control.

Customers are responsible for providing an accurate delivery address and contact information and for making reasonable arrangements to receive their shipment.

Incorrect, incomplete or unclear delivery information may result in delays or an inability to complete delivery.

Where a delivery fails because the customer cannot be contacted, refuses the package, provides incorrect delivery information or otherwise fails to make reasonable arrangements to receive it, additional delivery charges may apply in accordance with our Shipping Policy.

Nothing in this section excludes or restricts responsibility that cannot lawfully be excluded or restricted.


12. RETURNS AND REFUNDS

Returns, exchanges and refunds are governed by our Returns & Refunds Policy.

Products should be inspected before installation or use.

Opened fluids, installed automotive parts and products that have been damaged, contaminated, altered or otherwise made unsuitable for resale may be subject to return restrictions except where applicable law provides otherwise.

Nothing in our Returns & Refunds Policy or these Terms is intended to remove or restrict a right or remedy that cannot lawfully be excluded.


13. INTELLECTUAL PROPERTY

The content of our website, including DRL Performance Auto Limited branding, original text, graphics, photographs, videos, designs and other original materials, is owned by or licensed to DRL Performance Auto Limited and is protected by applicable intellectual property laws.

Third-party trademarks, vehicle manufacturer names, product names, logos and other intellectual property remain the property of their respective owners.

You may use our website for personal and lawful purposes. You may not reproduce, distribute, commercially exploit or misrepresent our original website content without permission except where otherwise permitted by law.


14. OPTIONAL TOOLS AND THIRD-PARTY SERVICES

Our Services may provide access to tools, payment services, integrations or other functionality supplied by third parties.

We do not control all third-party services and their use may be subject to separate terms and privacy policies.

DRL Performance Auto Limited is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make in our Store are made directly with DRL Performance Auto Limited.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and DRL Performance Auto Limited, including any injury, damage or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with DRL Performance Auto Limited, to the extent permitted by applicable law.

We reserve the right to correct genuine errors when discovered.

Where a material error affects an order already submitted, we may contact the customer to provide the correct information and allow the order to proceed where appropriate, or cancel the affected order and refund amounts already paid.

Where an Agent places or facilitates an order on behalf of a customer, the customer remains responsible for ensuring that vehicle information, delivery information, product selections and purchasing instructions supplied to the Agent are accurate.


22. TERMINATION

We may suspend or terminate access to our Services where reasonably necessary, including in response to fraud, unlawful activity, abuse, security threats or material violations of these Terms.

Termination does not affect rights, liabilities or payment obligations that arose before termination.


23. WARRANTIES, MANUFACTURER WARRANTIES AND STATUTORY RIGHTS

Certain products may carry warranties offered by their manufacturer, distributor or supplier. Any such warranty is separate from DRL Performance Auto Limited unless expressly stated otherwise and may be subject to its own conditions, exclusions, inspection requirements and claim procedures.

DRL Performance Auto Limited makes no additional manufacturer warranty on behalf of a third-party manufacturer unless expressly stated in writing.

Normal wear and tear, improper installation, misuse, abuse, neglect, accident, contamination, unauthorised modification, incorrect application or failure to follow manufacturer requirements may invalidate or fall outside applicable warranty coverage.

Nothing in these Terms excludes or restricts any condition, warranty, right, remedy or liability that cannot lawfully be excluded or restricted under applicable law.


24. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, DRL Performance Auto Limited shall not be liable for indirect, incidental, special or consequential loss arising from the purchase, installation, possession or use of products sold through our Services.

Without limiting the foregoing, to the fullest extent permitted by applicable law, DRL Performance Auto Limited shall not be responsible for losses, damage or expenses arising from improper installation, incorrect application, misuse, abuse, neglect, unauthorised modification, inadequate maintenance, contamination, incorrect or incomplete customer-supplied information, failure to follow manufacturer instructions or specifications, or continued operation after a fault, warning light, warning indication or abnormal condition becomes apparent.

To the fullest extent permitted by applicable law, claims for consequential expenses are excluded, including but not limited to:

  • Mechanic, technician or other labour charges;

  • Diagnostic or inspection charges;

  • Towing or vehicle-recovery costs;

  • Machine-shop charges;

  • Removal or reinstallation costs;

  • Storage charges;

  • Vehicle-rental expenses;

  • Substitute-transportation expenses;

  • Loss of vehicle use;

  • Loss of income or earnings;

  • Loss of profits or business; and

  • Other indirect, incidental, special or consequential financial loss.

Any information, fitment assistance or technical guidance provided by DRL Performance Auto Limited is based on information reasonably available at the time and information supplied by the customer. Customers and installers remain responsible for confirming the suitability of a product for the particular vehicle and application before installation where verification is reasonably possible.

Nothing in these Terms shall exclude or restrict any liability, right or remedy to the extent that it cannot lawfully be excluded or restricted under the laws of the Republic of Trinidad and Tobago.


25. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses, liabilities or reasonable costs arising from your unlawful use of the Services, material breach of these Terms, misuse of products or violation of the rights of another person.

Nothing in this section requires a customer to indemnify DRL Performance Auto Limited where such an indemnity would be prohibited or unenforceable under applicable law.


26. COMPLAINTS AND DISPUTE RESOLUTION

If you have a complaint, concern or dispute regarding an order, product, alleged product failure, delivery or any of our Services, you should notify DRL Performance Auto Limited in writing as soon as reasonably practicable.

Written complaints should include sufficient information for us to investigate the matter, which may include the customer's name and contact information, order or invoice information, vehicle details, a description of the issue, photographs, installation information and any other reasonably relevant supporting information.

Where a complaint concerns an alleged product defect, failure, accident or resulting damage, the customer should preserve the product and other relevant evidence where reasonably possible and should not discard, modify, repair or otherwise alter the product in a manner that would prevent reasonable inspection, except where action is reasonably necessary for safety.

Before commencing formal proceedings, customers are encouraged, and where permitted by applicable law may be required, to provide DRL Performance Auto Limited with written notice of the complaint and a reasonable opportunity to investigate and attempt to resolve the matter.

Nothing in this section prevents or restricts the exercise of any right, remedy, statutory complaint procedure or payment-dispute right that cannot lawfully be restricted.


27. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.


28. WAIVER AND ENTIRE AGREEMENT

Failure by DRL Performance Auto Limited to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or any other right.

These Terms, together with policies expressly incorporated into them, constitute the agreement governing use of our Services and purchases made through our online store, subject to applicable law.


29. ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our consent where such consent is reasonably required.

We may transfer rights or obligations relating to the operation of our business where permitted by law, including as part of a sale, restructuring or transfer of the business.


30. GOVERNING LAW AND JURISDICTION

These Terms, the use of our Services and transactions with DRL Performance Auto Limited shall be governed by and construed in accordance with the laws of the Republic of Trinidad and Tobago.

Subject to any right, remedy or jurisdiction that cannot lawfully be excluded or restricted, the courts of the Republic of Trinidad and Tobago shall have exclusive jurisdiction over disputes arising out of or relating to these Terms, our Services or transactions with DRL Performance Auto Limited.


31. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our Services, business practices or applicable legal requirements.

The latest version will be published on this page together with the date of the most recent update.

Material changes will apply from the effective date of the revised Terms and will not retrospectively remove rights already acquired in relation to completed transactions.
